1. Acceptance of Terms

By accessing or using the services provided by The IT Recycling Company (ITRC), you agree to be bound by these Terms and Conditions. If you do not agree, you may not use our services.

These Terms apply to all users, including businesses, organizations, and individuals engaging in IT asset disposition, recycling, data destruction, or related services.

2. Services Provided

ITRC provides services including, but not limited to:

  • IT Asset Disposition (ITAD)
  • Secure Data Destruction
  • Electronics Recycling
  • Equipment Buyback & Resale
  • Data Center Decommissioning
  • Logistics, Pickup, and Transportation

All services are subject to availability and may vary based on location, volume, and equipment type.

3. Client Responsibilities

By engaging ITRC services, you agree to:

  • Provide accurate and complete information about all equipment
  • Ensure lawful ownership of all items submitted
  • Remove or disclose any hazardous materials
  • Back up any data prior to transfer of equipment
  • Ensure equipment is properly prepared for transport unless otherwise agreed

ITRC is not responsible for data loss resulting from failure to back up data prior to service.

4. Data Security & Destruction

ITRC implements industry-standard processes for data destruction and handling. However:

  • Clients are responsible for identifying devices containing sensitive data
  • Data destruction services must be explicitly requested where applicable
  • Certificates of Data Destruction may be provided upon request

While ITRC follows strict protocols, no system can be guaranteed 100% immune from unforeseen risks.

5. Ownership Transfer

Upon transfer of equipment to ITRC:

  • Ownership of the equipment transfers to ITRC unless otherwise stated in writing
  • ITRC reserves the right to refurbish, resell, recycle, or dispose of equipment
  • Any data remaining on devices becomes the responsibility of the client prior to transfer

6. Quotes, Valuation, and Payments

  • All quotes are based on the information provided by the client
  • Final valuation may be adjusted after inspection
  • Adjustments may occur due to condition discrepancies, missing components, or non-functional
    items
  • Payment timelines vary based on service type and agreement

ITRC will communicate any adjustments prior to finalizing transactions

7. Logistics & Risk of Loss

  • ITRC may provide shipping, pickup, or transportation services
  • Risk of loss transfers based on agreed shipping terms
  • Clients are responsible for proper packaging unless ITRC provides materials

ITRC is not liable for damage caused by improper packaging by the client.

8. Environmental Compliance

ITRC operates in accordance with applicable environmental regulations and industry standards for responsible recycling and disposal.

ITRC does not claim certification unless explicitly stated.

9. Limitation of Liability

To the fullest extent permitted by law:

  • ITRC shall not be liable for indirect, incidental, or consequential damages
  • Liability is limited to the value of the services provided or equipment involved
  • ITRC is not responsible for loss of data, profits, or business interruption

10. Indemnification

You agree to indemnify and hold harmless ITRC from any claims, damages, or liabilities arising from:

  • Misrepresentation of equipment
  • Failure to comply with applicable laws
  • Unauthorized transfer of equipment or data

11. Service Refusal

ITRC reserves the right to refuse service for any reason, including but not limited to:

  • Unsafe or hazardous materials
  • Suspected unlawful activity
  • Misrepresented equipment

12. Privacy

Use of our services is also governed by our Privacy Policy, which outlines how we collect, use, and protect your information.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles.

14. Changes to Terms

ITRC reserves the right to update these Terms at any time. Changes will be posted on this page with an updated effective date.
